Abstract

지금까지 고독사 문제는 해당 노인들의 경제적 빈곤이나 지역사회가 떠안아야 하는 문제, 또는 노인의 가족들이 책임을 져야 하는 부양의 문제 등으로 바라보는 시각이 대다수를 차지해 왔다. 더욱이 고독사의 원인을 노인의 삶 속에서 일어난 특정한 사건이나 상황으로 인한 것이라고 보는 견해로서 개인의 내성적인 성향의 문제라든가, 가족과 단절된 상태에서 살려는 의지의 부족, 또는 경제적으로 충분한 힘을 가지지 못하였기 때문에 고독사가 초래되었다고 보는 입장이 계속해서 유지되고 있었으며, 또한 한국 사회가 점차 변화되면서 나타나는 불가피한 현상으로 사람들 사이의 라이프스타일이 점차 개인화 되면서 발생한 일종의 부작용 정도로 치부되어 왔다. 그러나 노인의 고독사 문제를 이처럼 단순한 사회적 현상으로서 그 개인과 개인이 속한 사회의 어떤 잘못으로 인하여 나타난 것으로만 접근하려는 입장에서 벗어나, 이제는 고령자들의 인권에 초점을 맞추어, 사회적 존재로서의 인간, 그리고 인간다운 삶을 보장하려는 태도 및 생명권의 유지와 보호라는 주제와 더불어 노인 고독사 문제에 접근해야 할 것이라고 생각된다.
따라서 본 연구는 노인 인권의 문제를 부각시키고, 인간의 존엄성 문제와 노인의 생명권 문제를 연결시켜, 인간답게 살 권리, 그리고 그 누구에게도 침해당해서도 안 되고, 양보해서도 안 될 인간으로서 가지는 고유의 권리를 보장하려는 차원에서 고독사의 문제를 바라보고, 그에 대한 대책들도 마련되어야 한다고 주장하였다.

To date, the issue of solitary death has been mostly considered as an issue related to the elderly’s poverty or that should be burdened by communities or an issue of support for which their family members should be responsible. Moreover, there have been continued opinions that solitary death was caused by a specific event or situation in the elderly’s life, a problem of the individual’s introverted disposition, a lack of the will to ive isolated from family or a lack of sufficient financial power. In addition, it has been regarded as an inevitable phenomenon in gradually changing Korean society and a kind of a side effect occurring as the people’s lifestyle has gradually been individualized. Yet, it is judged that now, the issue of solitary death of the elderly should be approached focusing on the seniors’ human rights with the topics such as human being as a social being, attitude toward securing human life and maintenance and protection of the right to life apart from a position to approach it as a simple social phenomenon appearing due to some faults of the individual and the society to which he or she belongs.
Thus, this study brought the issue of human rights of the elderly, connected the issue of human dignity and their right to life, viewed the issue of solitary death at the level of securing the right to live like a decent person and the inherent right that should be neither infringed by anyone nor given away to anyone and insisted that actions for it should be prepared.
