Abstract

현재 국민연금공단에서 시행하고 있는 장애심사는 국민연금법상 장애연금심사와 장애인복지법상 장애등급심사로 이원화 되어있다. 본 연구의 목적은 국민연금법과 장애인복지법의 장애개념 및 장애판정기준에 대한 구체적이고 체계적인 비교분석을 통해, 두 법의 유사점과 차이점을 분석하고 이로 인한 문제점을 파악하며, 두 법의 장애판정기준 일원화의 타당성을 검토하는데 있다. 연구결과 두 법의 제정 목적 및 장애개념과 관련해서는 비교적 명확한 차이가 발견되는 반면, 장애유형 및 장애판정기준과 관련해서는 상대적으로 일치 또는 유사한 부분이 있는가 하면 상이한 부분도 존재함이 확인된다. 현행 국민연급법과 장애인복지법의 장애판정기준 및 등급기준은 실제 등급 간 차이가 있어서 합리적이지 않고 일관성이 결여되어 있으며, 이로 인해 장애유형 내의 등급 간 차이와 장애유형 간의 등급 간 차이가 발생하고 있다. 따라서 이것을 일관성 있게 조정할 필요가 있다. 그리고 이를 위해 의학적 손상 평가 기준의 일관성의 일원화가 필요하다고 판단된다.두 법의 의학적 손상 기준의 일관성의 일원화는 행정적 비효율성, 등급결정에 대한 고객의 불만제기 및 공단의 장애심사업무에 대한 신뢰도 저하의 문제를 해결하는데 효과적인 방안이 될 수 있을 것으로 예상된다.

This study compares the concepts of disability and disability judgement criteria for National Pension Act and Welfare of the Disabled Act. First, it analyzes the similarities and differences between the two Acts and explores what the problems derived from them are. Second, it examines whether the unification of the judgement criteria for the two Acts are adequate. The results of the analysis show though there are comparatively clear distinctions of the objectives and concepts of disability for the two Acts, it is also found that there are both similarities and differences with regard to disability types and judgement criteria. The current disability judgement criteria for the two Acts are not reasonable and the lack of consistency because there are differences between the grades of disability. This causes discrepancies between the grades within a disability type and those between the grades among the disability types. Therefore it is needed to improve the consistency and for this, the unification of the consistency of the impairment based Barema methods for the two Acts is needed.
